General terms and conditions for service providers
These general terms and conditions regulate the contracts between the users of www.amitrips.com and service providers.
AMI shall register the service providers who have completed the specific AMI form, have provided true and accurate information and added appropriate documentation (including certificates, mandatory business risk insurance policies etc.), which the AMI shall have the right to verify. Within 30 calendar days the AMI shall approve the service provider, conclude an agreement and grant a separate account on the Platform. If the AMI has not approved the service provider within this period - the agreement has not been concluded and the service provider is not registered.
Upon registration, the service provider at their own accord shall send and coordinate with the AMI the service description and price. After the approval of the service, the service provider shall work from their AMI account, indicating complete information about the service, the user eligibility, the price. The service price shall be complete and shall include all additional costs - taxes, fees, commissions etc. The service provider may not require from the user any additional fees that are not included in the price. Exceptions must be specified in the description of the service. AMI shall have the right to delete services that are not appropriate or coordinate without any liability to the service provider.

The service provider accepts booking only from persons who are fully capable and with full legal understanding.
The booking is made:
The information provided by the user on the AMI booking platform must be true. The service provider has the right to cancel the booking, if false information is provided. In this case the money paid shall not be returned.
The user shall be responsible for a timely arrival at the meeting place. If the user arrives from abroad, he or she is personally responsible for the required travel documents (passport etc.) and compliance with the health regulations etc.
If the service provider is not present at the agreed location and does not contact you within 15 minutes after the agreed time, call us at +371 20032320.
If you believe that the service provider does not comply with the general terms or you have doubt about the service you have the right to withdraw from the service provision, to do so, you must immediately call us at +371 20032320 and provide your details, locations, the service booked etc. Wherever possible, try to record the inadequate service in photographs, witness statements or any other means of communication or record. Remember that your safety is important!
The user is personally liable for the compliance with the terms of service. The service provider has the right to refuse your participation in the activity, if you do not meet these conditions. In this case the payment shall not be refunded.
The service provider has the right to refuse to accept or to exclude the user from an event or activity, if the user does not meet the terms of compliance or the participation of the user puts himself or herself or other persons at risk or otherwise interfere with a proper execution of the service. In this case the money paid shall not be returned.
The contract between the user and the service provider shall be concluded when the service provider shall confirm the user’s booking request. Upon booking a tour or another activity the user applies to a binding offer with the service provider which shall be binding for 24 hours. If the service provider confirms the user’s booking within this period the contract has definitely been concluded. The user shall be notified about it by e-mail.
AMI shall charge a commission from the service provider for the maintenance and use of the booking platform. Fees are determined separately for each service provider and shall not be charged from the User.
The service provider shall make the transfer of the commission to the AMI under mutual contract or agreement which has been concluded upon the registration of the service provider with the AMI website account. The commission payment is charged automatically upon the booking confirmation and the payment of the service fee. The AMI shall choose the money transfer operators and the system, in accordance with the international principles governing the money transfer and security. The AMI shall cover the bank transfer costs to the service provider, while the service provider shall cover the bank transfer costs to the AMI.
On the 10th day of each calendar month the AMI shall make the payment to the service provider of the total revenue from the services provided during the previous month. If the 10th day of the calendar months is a holiday, the transfer shall be made on the next business day.
In the event of a dispute, the law applies to the contract between the user and the service provider. If the law defines the right of withdrawal in favour of the user, the user shall be entitled to use these rights as defined by the applicable laws and regulations. The AMI shall not be liable for late payment to user nor the service provider, including due to inaccurate or false information.
Insurance is not included in the price of the service. The user is personally responsible for purchase of the appropriate insurance. The type of insurance can be determined based on the booked activity.
If the user fails to pay for the booked service or cancels the payment, the user’s booking request shall not be valid. The matter shall be regulated by the cancellation and refund provisions set out in Article 18. The AMI shall not be liable if the user cancels or fails to pay for the service, but shall notify the service provider of this.
All communications between the user and the service provider shall be carried out via AMI booking platform. Dedicated forms are provided by the AMI for this purpose. Thus, the user can be sure about the reliability of the service and the booking provided by the service provider.
Messages sent via alternate means of communication other than the AMI booking platform or dedicated forms shall not be accepted and shall have no legal effect.
After the service provision the user shall receive an e-mail request to evaluate the service and share their experience or leave any additional useful information.
These reviews shall be visible to all customers. The service provider is not able to respond to a specific user review on the website. In this way each service provider will be able to increase their rating among other service providers with positive and encouraging feedback. Insofar as possible the AMI shall control the content of the feedback and shall delete insulting, rude or false reviews. The reviews are also used for analytical and statistical work and the service provider is not entitle to copy, publish or otherwise use the reviews or rating results published on the AMI website.
If the service does not provide the cancellation terms, the following cancellation fees shall be applied by the service provider:
- more than 48 hours before the start of the activity: full refund
- less than 48 hours before the start of the activity or in case of absence: no refund.
The user has the right to prove that the service provider has suffered less damage due to cancellation than specified by these terms.
The refund shall be made within 20 working days to the credit card used by the user.
If a credit card payment has not been completed or is cancelled before the use of the booked service, this shall be deemed to be a cancellation of the booking and the cancellation fees shall apply. Any further claims for damages shall be invalid.
The service provider may cancel the service notwithstanding the cancellation period, if the weather conditions, government actions or force majeure circumstances affect or make the execution of the activity impossible. In this case the service provider shall inform the AMI by sending a notification to firstname.lastname@example.org and the AMI shall immediately notify the user.
In this case no refund is possible due to general laws and regulations. All the parties involved shall try to resolve the emergency by careful and comprehensive assessment.
The service provider has the right to unilaterally make changes in the program, if is necessary due to unforeseen or unavoidable circumstances, taking into account and respecting alternative options, commitments and agreements, as well as these provisions.
The service provider shall grant the AMI free right and a valid licence (or if required a sub-licence) in all countries of the world with the right to use and provide access to all content (including text, images, video) describing the Service provider’s offer/services on the website.

The time and date shall be set in accordance with the service provider’s time zone.
The service provider shall be liable in accordance with the applicable laws and regulations. The obligations or the contract shall be taken into account in so far as permitted by the applicable laws and regulations.
These terms and conditions are subject to change without notice. The specific booking shall be regulated by the provisions of the current applicable terms and conditions. The user agrees that any future bookings shall be made taking into account the current applicable terms and conditions.
The legal relationship between the user and the service provider shall be regulated by the provisions of the laws and regulations applicable to the service provider.
